Please read the follow "Terms and Conditions" of your Holiday Booking as these "Terms and Conditions" are an agreement between you the "Guest, the "Owner" of the "property" booked by you via the managing agent, Holidays by Design.
HOLIDAYS BY DESIGN
TERMS and CONDITIONS
1. OCCUPANTS The number of occupants is restricted to the number specified in this booking. Failure to comply with this condition will render the tenancy subject to immediate cancellation and forfeiture of all rental & bond paid.
2. PAYMENT TERMS, FEES & SECURITY BOND PAYMENT TERMS: In order to secure a booking, 50% of the total booking value is to be paid at the time of booking confirmation. The remaining 50% is due 14 days prior to your stay. If a booking is not paid in full, 14 days prior to Check-In the booking will not be held. If your booking is made within 14 days of your Check In date, then the total is due upon confirmation. All payments are processed securely via credit card transaction using online payment gateway. Once the guest credit card payment details are received, payments will be automatically charged as per the afore mentioned timing. PAYMENT METHOD: We use Stripe Online payment processing. Credit or Debit Card details are stored securely using and your payments are auto scheduled as per our payment terms above. Returning guests who have advised a payment method for a prior booking will have their new booking charged to the credit or debit card which was originally stored for their past booking.
SECURITY BOND: In addition to the booking total, a credit card authorization hold will be held against the guest's credit card as a security bond. The bond hold will be implemented 1 day before Check In and automatically released after 7 days, providing no damage, breakage and/or additional cleaning fees are reported. If a booking is longer than 7 days duration, the Authorisation hold will be released after the check out date, providing no damage, breakage and/or additional cleaning fees are reported. The amount of the bond is $600 - $1000 depending on the booked property. If the guest does not provide a credit card, a bond will be invoiced to be paid in full before arrival. If we are unable to process an authorisation hold on the guest credit card, we can not give out the keys on check in. The guests shall be liable for any loss or damage caused by guests or their visitors to the landlord’s property during the term of their tenancy and agrees to pay for any damage, breakages and/or additional cleaning of the premises. Where a bond has been paid, such monies shall be applied towards rectification costs. If the cost of rectification is higher than the security bond an invoice will be sent to cover for the extra cost. In the event that a bond claim is required this will incur credit card surcharge of 2.08% of the transaction amount.
3. CANCELLATIONS AND REFUNDS Guests who cancel at least 30 days before check-in will be refunded amount paid less a $100 cancellation fee. Guest cancellations between 14-30 days before booking commencement will be refunded 50% of the total booking. If a guests cancels within 14 days there is no refund. If the guest decides to leave early after check-in, the nights not spent are not refunded.
4. ARRIVAL Check in and Key instructions are sent via the booking channel or via email 7 days before the arrival date. Key instructions will only be arranged after full payment of accommodation fare and fees. If you are not at the office at the appointed check in time the guest should contact a company representative to arrange a new key pick-up.
5. NO PARTY - NO NOISE POLICY Where applicable, the guest or their visitors shall comply with all Body Corporate rules and regulations and shall not create or permit any noise or nuisance that is likely to interfere with the peaceful enjoyment of any other person occupying adjoining premises. Any person(s) found to be creating excessive noise, having a party in the property or exceeding the numbers of permitted guests, will be at risk of eviction. All money, deposits, and rents will be forfeited in case of violation of this condition.
6. PETS Unless otherwise agreed in writing prior to commencement of the tenancy, no animals or birds are permitted on any part of the premises. If animals are found to have been on the property during the term of your tenancy you forfeit all rights to the remainder of your tenancy term and any rent or bond that may have been paid. This excludes prior arrangements with the agent and landlord, unless otherwise stated.
7. KEYS If keys are locked in the property or lost and a company representative is contacted to issue another set of keys, a $40 call out fee will apply plus any necessary costs to re-cut keys or change locks.
8. GUEST PROPERTY No responsibility whatsoever is taken for the property of the guest on or near the premises.
9. PARKING The guest must use the designated parking bay only. Do not park on lawns or gardens or interfere with any irrigation systems.
10. DEPARTURE The property is to be left in a clean and tidy manner i.e. dishes done & packed away, floors swept/vacuumed, beds made, BBQ clean etc. Bins can be left on the kerbside for pick-up. If you are not at the office at the appointed check out time and it is necessary for our representative to leave the premises and return at a later time, a penalty rate will apply , unless there is a prior arrangement with Holiday management staff. In the event that our representative must wait for the guest to be checked out of the subject property, a fee of $40.00 will apply and will be additionally charged at $40.00 for every hour thereafter. You must remove all belongings upon vacation. Should the agent be required to return to the premises after your stay to collect an item charges will apply (minimum fee is $20 + additional postage if required)
11. LANDLORD CANCELLATION The agent has confirmed the initial booking with the landlord. However, in the event that the landlord cannot fulfill the booking date for any reason, the Agent will refund any rental deposit or bond paid by the guest. The Agent will offer the guest the option to relocate to another property of a similar standard and location if available at that time.
12. PROPERTY DESCRIPTION The agent cannot be held responsible for any actions or changes made by the landlord of the premises. In the case of all bookings the description and inventory of the premises supplied by the agent is made in good faith but without acceptance of any responsibility whatsoever for any miss description or inventory alterations.
13. LIABILITY No liability is accepted in contract for any injury, debt, damage, loss, delay, expense or inconvenience caused directly or indirectly by events beyond the agent or owner’s control, or which are not caused by neglect or default by the agent or owner.
14. NO SMOKING Strictly no smoking is permitted inside the rental property or forfeiture of bond will result. All butts to be disposed of appropriately.
15. CARAVANS AND TENTS No caravans or tents are to be erected on any part of the property without prior written consent from the landlord.
16. AGE At all times a person over the age of 18 must reside at the property that will be responsible for all under age guests or visitors.
17. PRIVACY POLICY We require your contact details in order to create a booking in your name. You will be asked to provide your name, address, phone-numbers and email address so that we can stay in touch with you regards to the booking arrangements. We don't share the booking contact information and other details with anyone else under any circumstances, unless we are required to do so for legal reasons. We do not show your email address or any other details on any website. Your contact information will only be used for the purpose for which you provide it, and will not be added to a mailing list unless you request that this be done. We will not disclose it further without your consent or if required to do so for legal reasons.
18. INFORMATION PROTECTION : We adopt appropriate data collection, storage and processing practices and security measures to protect against un-authorised access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site. Sensitive and private data exchange between the Site and its Users happens over a SSL secured communication channel and is encrypted and protected with digital signatures. Our Site is also in compliance with PCI vulnerability standards in order to create as secure of an environment as possible for Users.
